1. WHAT YOU'RE BUYING
When you purchase a plot on The Forever Canvas ("the Canvas"), you're buying a display service: we will display your submitted image (pixelated to your plot's dimensions), your note of up to 50 characters, and one optional link, at your chosen coordinates on the Canvas, accessible via a permanent coordinate permalink.
To be clear about what you are not buying: you are not buying property, digital or otherwise. You don't own the pixels, the coordinates, or any part of the website. A plot is not an asset, an investment, or a token of any kind, and we make no representation that it has or will have any resale or monetary value.
2. HOW LONG YOUR PLOT STAYS UP
The Canvas is designed to run indefinitely — permanence is the point of the project, and keeping the Canvas online is inexpensive by design. We formally guarantee that your plot will remain displayed for a minimum of 2 years from the date it goes live, subject to the Content Policy below.
If we are ever genuinely unable to continue operating the Canvas within your guaranteed period, we will either (a) preserve the Canvas as a publicly accessible static archive, or (b) refund you a pro-rata portion of your purchase price for the unexpired guaranteed period. That is the full extent of our liability for discontinuation.
3. PAYMENT, PRICING AND THE 5-MINUTE HOLD
- All prices are in pounds sterling. The price per pixel is displayed on the Canvas at the time of purchase and may increase as the Canvas fills, according to the published tier schedule. The price you pay is the price shown at your checkout — later price rises don't affect completed purchases, and earlier lower prices can't be claimed retrospectively.
- When you claim a plot, it's reserved for you for 5 minutes. If you don't complete payment within the hold period, the plot is released and may be bought by anyone. A hold is not a purchase.
- Payments are processed by Stripe. We never see or store your card details.
4. ALL SALES ARE FINAL
Because your plot is personalised to you and supplied immediately on payment, all sales are final and there is no right to cancel or refund for change of mind. At checkout you will be asked to expressly consent to immediate supply and acknowledge that you lose any statutory right to cancel. If you don't agree, don't complete the purchase.
The exceptions, which work in your favour:
- Our mistake: if we remove your plot and, on review, it did not breach the Content Policy, we'll restore it or refund you in full — your choice.
- Our failure to deliver: if we fail to display your plot as described, or discontinue the Canvas within your guaranteed period, section 2 applies.
- Nothing in these terms limits your statutory rights where the law says they can't be limited.
5. CONTENT POLICY
Your plot appears on the Canvas as soon as payment completes. We review content after publication and remove anything that breaks the rules — usually quickly, and without a refund. Keep it legal and keep it decent. The following are not allowed, in images, notes, or linked destinations:
- Illegal content of any kind, or content promoting illegal activity;
- Adult or sexually explicit content, or content sexualising anyone;
- Hate, harassment or threats directed at any person or group;
- Scams and deception, including phishing, fraudulent schemes, misleading financial promotions, and malware links;
- Infringing material — content you don't have the right to use, including other people's trademarks, artwork, or likenesses;
- Private information about any person without their consent;
- Anything else we reasonably judge harmful to users of the Canvas or to the project. Our decision on borderline content is final — it's our wall.
By submitting content you confirm you have the right to use it, and you grant us a worldwide, non-exclusive licence to display, resize, pixelate, and reproduce it as part of operating and promoting the Canvas (for example, screenshots of the Canvas that include your plot). You keep ownership of your content.
6. NO RESALE OR TRANSFER
Plots are personal to the purchaser and may not be sold, transferred, or exchanged. We may introduce an official transfer mechanism in future; until then, any purported sale or transfer of a plot has no effect and we won't recognise it.
7. THE BORING BUT IMPORTANT LIMITS
- The Canvas is provided "as is". We'll take reasonable care to keep it online and working, but we don't guarantee uninterrupted availability, and short outages, maintenance windows, or display glitches aren't breaches of these terms.
- Our total liability to you in connection with your purchase is limited to the amount you paid for your plot. We're not liable for indirect losses, lost profits, or lost expectations of value.
- Nothing in these terms excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence.
- We may transfer the operation of the Canvas (for example, if the project is sold). Your rights under these terms travel with it.
- These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — though if you're a consumer elsewhere in the UK or EU, you keep any mandatory protections and local court rights the law gives you.
8. PRIVACY, BRIEFLY
We collect what we need to run the Canvas: your email (receipts, plot notifications, and — if you opted in — the mailing list), your purchase details, and your submitted content. Payment details are handled entirely by Stripe. We don't sell your data. To ask about or delete your data, email hello@theforevercanvas.com. A fuller privacy policy will be published before the Canvas opens.
